Terms of Use

These Terms govern access to the Allocly website, TradingView indicator, documentation, support and any optional subscriber community.

These Terms of Use (the “Terms”) form a legal agreement between you and Allocly, operated by Kajetan Tomalik conducting unregistered activity in Poland (działalność nierejestrowana) (“Allocly”, “we”, “us” or “our”). By purchasing a subscription, checking the acceptance box, accessing the Service or using any Allocly material, you agree to these Terms and the policies incorporated into them, including the Privacy Policy, Refund and Cancellation Policy, Risk Disclaimer, Email Policy and Cookie Policy. If you do not agree, do not purchase or use the Service.

1. The Allocly Service

Allocly provides subscription access to proprietary analytical tools delivered primarily as invite-only scripts or indicators on TradingView. The Service may also include product documentation, setup instructions, educational materials, technical support, product updates and optional Discord or other community access.

Allocly is a software and analytical tool. It is not a broker, exchange, investment adviser, financial adviser, portfolio manager, asset manager, copy-trading service, managed-account provider or personalized signal service.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement.
You may use the Service only where your purchase and use are lawful.
You are responsible for having a compatible device, internet connection and TradingView account.
You are responsible for reviewing TradingView’s own terms, plan requirements and platform limitations.

3. Subscription membership

Allocly offers recurring monthly and yearly subscription plans. Unless a plan is clearly described as non-renewing, your subscription continues and renews automatically until cancelled. You authorize Stripe and Allocly to charge the payment method associated with your subscription for each renewal, together with applicable taxes and charges.

The price, billing frequency and renewal terms displayed at checkout form part of your purchase. No free trial is offered unless the checkout page expressly states otherwise.

4. TradingView access and activation

You must provide your exact TradingView username during checkout or when requested by Allocly.
After successful payment and receipt of a valid username, Allocly normally aims to activate access within 24 hours.
An incorrect, incomplete or changed TradingView username may delay activation. You must contact support with the correct details.
Access is personal to the subscriber and may not be shared, transferred, rented, resold or used for another person.
You do not acquire ownership of the script, source code, logic, settings, documentation or any other Allocly intellectual property.

TradingView is an independent third-party platform. Allocly is not affiliated with, endorsed by or sponsored by TradingView. TradingView may change its platform, plans, rules, data, features or availability at any time.

5. Optional Discord or community access

Allocly may offer access to a Discord server or another community space as an optional subscriber benefit. Community access is intended for product information, onboarding, general education, technical discussion and support. It is not a signal room or personalized financial advisory service.

Community access may be limited to active subscribers.
You must not share private channels, protected materials or another person’s personal information.
Spam, harassment, unlawful content, impersonation, misleading profit claims, unauthorized advertising and attempts to copy or resell Allocly are prohibited.
Allocly may moderate content and remove community access where necessary to enforce these Terms or protect users and the Service.

6. Payments, billing and taxes

Payments are processed by Stripe or another payment provider identified at checkout.
Allocly does not store full payment-card numbers.
You must keep your billing information and payment method accurate and current.
If a payment fails, is reversed, disputed or appears fraudulent, access may be suspended while the issue is reviewed.
Prices are normally displayed in USD. Your bank or payment provider may apply exchange or transaction fees.
Taxes may be added or included as shown at checkout, depending on your location and applicable law.

7. Price and subscription changes

Allocly may change prices or subscription features for future billing periods. Material changes affecting an active consumer subscription will be communicated in advance where required. A new price will not be charged retroactively. You may cancel before the change takes effect if you do not wish to continue, and any additional consent required by mandatory law will be obtained.

8. Cancellation

You may cancel future renewals through the Stripe customer portal or by contacting Allocly support. Cancellation takes effect at the end of the current paid billing period unless the Service is terminated earlier for breach or applicable law requires another result.

Cancellation is not a refund

Cancelling stops future renewals. It does not automatically reverse or refund the payment for the current monthly or yearly billing period. You normally retain access until that paid period ends.

You are responsible for cancelling before the renewal is processed. A support request received after a renewal does not automatically create a refund right. Details are set out in the Refund and Cancellation Policy.

9. Refunds and mandatory consumer rights

All payments are non-refundable after access has been activated, except where Allocly approves an exception or a refund, withdrawal right, price reduction or other remedy is required by mandatory law. Allocly does not offer a voluntary 14-day free trial or money-back guarantee.

Nothing in these Terms excludes consumer rights that cannot legally be excluded. Where a statutory right is exercised, Allocly may remove access immediately and will determine any amount payable or refundable in accordance with applicable law.

10. License and intellectual property

Subject to an active paid subscription and compliance with these Terms, Allocly grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to use the Service for your own analysis.

All rights in the Allocly brand, website, indicators, scripts, logic, source code, settings, visual elements, documentation, videos, text, graphics and community materials remain with Allocly or its licensors.
You may not copy, reproduce, publish, translate, modify, distribute, sublicense, sell, rent, reverse engineer, decompile, disassemble, scrape, extract or recreate any protected part of the Service.
You may not remove copyright, brand, access-control or proprietary notices.
No license is granted to use Allocly as part of a product, paid signals service, managed-account service or competing indicator without written permission.

11. Prohibited use

Sharing access or allowing an unauthorized person to use the indicator or subscriber materials.
Reselling, redistributing, sublicensing or commercially exploiting the Service without written permission.
Attempting to discover, copy or reveal protected code, logic, settings or private materials.
Using bots, scraping, crawling, extraction or security-bypass tools against the Service.
Uploading malware, disrupting systems, circumventing access controls or attempting unauthorized access.
Making false, deceptive or guaranteed-profit claims about Allocly.
Using the Service to provide regulated financial services without any authorization required by law.
Violating applicable law, TradingView rules, Discord rules or third-party rights.
Harassing, threatening, impersonating, doxxing or unlawfully collecting information about others.
Using fraudulent payment methods or abusing payment disputes or chargeback procedures.

12. User communications, feedback and testimonials

If you send feedback, a review, testimonial, suggestion, screenshot or other material to Allocly, you confirm that you have the right to provide it. Allocly will not publicly identify you or use your testimonial for marketing without an appropriate permission or other lawful basis.

Testimonials describe individual experiences. They are not representative, typical or guaranteed results and must not be interpreted as financial performance promises.

13. Information accuracy and educational materials

Website descriptions, documentation, examples, historical charts, settings and educational content may contain errors, omissions or information that becomes outdated. Allocly may correct or update them. You should not rely on Allocly as the sole source for any financial decision.

14. Third-party services and links

The Service depends on third parties including Stripe, TradingView, Discord, hosting, email, analytics and security providers. Their products, policies, data and availability are outside Allocly’s control. Links to third-party sites are provided for convenience and do not mean that Allocly accepts responsibility for their content or practices.

15. Availability, updates and force majeure

Allocly aims to provide reliable access but does not guarantee continuous, secure, error-free or backward-compatible operation. Maintenance, software updates, TradingView changes, market-data differences, internet failures, cyber incidents, provider outages, legal requirements and events beyond reasonable control may affect the Service.

Allocly may modify, replace, rename, improve, suspend or discontinue parts of the Service. Where a material change affects a paid consumer service, Allocly will act in accordance with applicable law.

16. Support

Support covers reasonable assistance with payment identification, access activation and general product use. It does not include personalized trading decisions, investment advice, broker support, tax advice or legal advice. Response times are not guaranteed unless expressly stated.

17. Suspension and termination

Allocly may suspend or terminate access if you fail to pay, violate these Terms, share or resell access, misuse the Service, engage in fraud, create security or legal risk, or abuse support or community spaces. Where appropriate, Allocly may give an opportunity to correct the issue, but immediate action may be taken for serious breaches.

Terms concerning intellectual property, payment obligations, disclaimers, liability, disputes and provisions that by their nature should survive will continue after termination.

18. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available”. Allocly does not promise that the Service will be uninterrupted, error-free, suitable for your strategy, accurate for every market or capable of producing a particular result.

19. Limitation of liability

To the maximum extent permitted by law, Allocly is not liable for trading or investment losses, lost profits, missed opportunities, market movements, broker execution, taxes, third-party outages, data-feed differences, user configuration, indirect loss, consequential loss or loss caused by reliance on indicator output.

Nothing in these Terms limits liability that cannot legally be limited, including applicable mandatory consumer remedies or liability arising from intentional misconduct where exclusion is prohibited.

20. Indemnity

To the extent permitted by applicable law and primarily in relation to business users, you are responsible for claims and reasonable costs arising from your unlawful use of the Service, infringement of third-party rights or material breach of these Terms. This section does not remove non-waivable consumer protections.

21. Governing law and disputes

These Terms are governed by the laws of Poland, without depriving consumers of mandatory protections available under the law of their habitual residence. Before filing a formal claim, you are encouraged to contact Allocly so the issue can be reviewed. Any dispute will be handled by a court or authority having jurisdiction under applicable law.

22. Severability and entire agreement

If any provision is invalid or unenforceable, it will be limited or replaced to the minimum extent necessary, and the remaining provisions will continue. These Terms together with the incorporated policies and checkout information form the agreement concerning the Service.

23. Changes to these Terms

Allocly may update these Terms. Updates will be posted with a revised date. Material changes affecting an active subscription will be communicated where required by law.
